1. Scope

These Terms of Service (ToS) govern the use of the TitanPro mobile application (hereinafter referred to as “App”).
By using the App, you fully accept these ToS.

2. Description of Service

TitanPro is a fitness tracking application that allows users to:

• Create and manage training plans

• Select or create exercises

• Track and analyze progress

• Share training plans with others

3. Use of the App

• The App may only be used for private, non-commercial purposes.

• Misuse, improper use, or commercial use is prohibited.

• You agree to use the App in compliance with applicable law.

• The App may not be used for illegal or harmful purposes.

4. Costs, Trial and Subscription

• A subscription is required to use the App.

• A free 14-day trial period automatically begins with subscription via the Apple App Store.

• You may cancel during the trial at no cost.

• After the trial, the subscription automatically renews monthly.

• Prices are based on Apple App Store pricing in your country.

• Cancellations must be made via the Apple App Store and take effect at the next billing cycle.

• Prices may change, and any changes will be announced in the App Store.

• Apple App Store terms and conditions for payment and cancellation apply.

5. Liability and Warranty

• Use of the App is at your own risk.

• The App does not provide medical advice. Consult a doctor before starting any training program.

• We are liable only for intent and gross negligence.

• Liability for indirect damages is excluded.

• Liability is limited to the subscription fee.

• Liability for damages resulting from injury to life, body, or health remains unaffected.

• We do not guarantee uninterrupted availability.

6. Data and Privacy

Data processing is carried out according to our separate [Privacy Policy], available within the App.

7. Intellectual Property

• All rights remain with the developer.

• You receive a simple, revocable, non-transferable license to use the App.

• Copying, modifying, or reverse engineering is prohibited.

• All content, design, and technology are protected.

• Redistribution is not permitted.

8. Changes to the ToS

• We may update these ToS as needed.

• Changes will be announced within the App.

• Significant changes will be announced at least 30 days before taking effect.

• If you do not agree, you may cancel your subscription before the changes apply.

9. Termination

• You may cancel your subscription at any time via the Apple App Store.

• We may suspend the App or your account in case of ToS violations.

• After termination, access to premium features ends.

• Subscription fees already paid will not be refunded, except where legally required.

• In case of serious violations, we may terminate immediately.

10. Availability and Updates

• We strive for high availability.

• Planned maintenance will be announced in advance.

• Updates are provided automatically via the Apple App Store.

• We may modify or discontinue the App at any time.

• In case of discontinuation, users will be notified in advance.

11. Support and Contact

• Support is available for technical issues.

• Support is only available to active subscribers.

12. Governing Law

• Swiss law applies.

• Place of jurisdiction is Switzerland.

• Mandatory consumer protection laws of your country remain unaffected.

• The UN Convention on Contracts for the International Sale of Goods does not apply.

13. Severability

If any provision is invalid, the rest of the contract remains valid. Invalid provisions shall be replaced with valid ones closest to the intended purpose.
